			<content:encoded><![CDATA[<p>A TIMELY report by the Consumer Rights Commission of Pakistan has focused on the asymmetries in consumer finance in Pakistan that are squeezing the general public. While banks reap record profits (in 2006 the pre-tax profits of all banks was a record Rs123.4bn), the benefits that have been passed on to customers have been inadequate. Most criticised has been the interest spread — generically, the difference between the rate at which a bank lends money to customers and the rate at which it pays depositors for their money — which has remained persistently and unjustifiably high. According to the CRCP report, the spread has ranged between approximately six and 10 per cent between 1990 and 2005, and in recent years has averaged over seven per cent. The banks justify the spread on the grounds that the cost of doing business in Pakistan is high and that their lending rates are reflective of the difficult economic environment here. Consumer rights advocates reject this argument, pointing to the record profitability of banks. At the very least, critics of the banking sector argue that banks have opaque cost structures and the high spread may be hiding inefficiencies within the sector that the consumer is being forced to pay for. The governor of the State Bank, Dr Shamshad Akhtar, has since early in her tenure tried to nudge banks into lowering their interest spreads and while they have come down in the past year, the feeling persists that the reduction has been too little and occurred too slowly.</p>
<p>Beyond the big issue of an unfair interest spread, the CRCP report highlighted the problems in the provision of the main consumer financing products, especially credit cards, car financing, personal loans and house financing. The banks do little to explain banking terms and conditions, resulting in customers signing up for loans and other products that they may not be able to afford. For example, the report highlighted the problem with variable markup loans — the majority of consumer loans — which become more expensive to service even as salaries lag behind inflation. Then there are the issues with hidden charges on credit cards and ATM machines that do not function adequately. Processing delays, unsolicited banking and unauthorised debits add to the woes of the consumer. Overall, the report gives the picture of an immensely profitable banking sector that has greatly enhanced the scope of products available to consumers, but has failed in providing services efficiently and with minimal fuss to customers. This is a regulatory failure that is in part caused by a timid State Bank keen to maintain a buoyant, attractive banking sector. However, the CRPC report is a reminder that the trade-off between the banks’ interests and the customers’ interests needs urgent readjustment.</p>

Most American families must have more than one car these days. But in this tough economy, where people are losing jobs every day, or at least one family member is, most people are not in the position to pay cash for a new or used car. In past years it was exceedingly difficult for anyone with a tarnished credit history to obtain auto loans. Bad credit was not accepted.</p>
<p>This practically meant that, if your credit were bad, you would be saving money for probably years in order to buy a car. Thankfully, that was in the past. Today almost all auto dealerships have a &#8220;special finance&#8221; department that works with individuals that have credit issues that would prevent them from applying for conventional auto loans. The loans that they offer are called bad credit auto loans.</p>
<p><strong>Bad Credit Auto Loans are nothing to be Ashamed of</strong></p>
<p>Just because you have some bad credit issues in your past is no reason to be ashamed. It truly happens to just about anyone; rich and poor, believe it or not. You can be earning six figures or more and still have a bad credit rating! Nevertheless, as a consumer it is in your best interest to keep your credit score as high as possible. By exercising restraint, not overextending yourself, and paying your bills on time, your credit rating will naturally grow. But, in the mean time, there is no reason why you have to wait to buy a good new or used car because auto loans for people with bad credit are available online. </p>
<p>There are a number of steps that a consumer can take to improve their chances of being approved for bad credit auto finance.</p>
<p><strong>Qualifying For an Auto Loan</strong></p>
<p>* First, However; one should do the math and decide if it is affordable to take on another car payment and insurance payment and the other associated costs along with your current bills.</p>
<p>* Get copies of your latest credit report from all three credit reporting bureaus because some lenders will report to one or two bureaus, but not to each of them. Make yourself familiar with what is on your credit report at this time. If there are any errors or mistakes, you should have them retracted. Just write a letter to the credit reporting bureau and inform them of the errors and they should retract them for you.</p>
<p>* If you are applying for bad credit auto loans, consider how much of a down payment that you can afford. If you have good or fair credit, you may not need a down payment. However; if you have bad credit, auto loans that you apply for will almost certainly require a down payment. And of course, the higher the down payment, the lower your monthly payment will turn out to be.</p>
<p>* Although not mandatory for auto loan bad credit online, a cosigner can be very helpful. With a co-signer, you can get a lower interest rate and better terms on your bad credit auto finance. Remember, a co-signer should have a good credit rating and a good credit history. This person also needs to be aware, that in the event of your default on the loan, they will be liable to pay off the balance of the loan. So, the cosigner should not cosign for a loan they cannot afford to repay.</p>
<p>Finally, it is very critical that you do your due diligence on the lender or car dealership that you choose to work with. Research the lender or auto dealership thoroughly online. After all, you plan to go into debt with these companies. Pay close attention to the interest rate. When you finally go to the lender or dealership, try your best to negotiate the interest rate down. There is usually some wiggle room there.</p>

<p><strong>1.</strong> Service tax authorities, of late, have been issuing notices to various borrowers of External Commercial Borrowings (ECB’s) from foreign branches of Indian banks and holding them liable to pay &lt;a rel=&#8221;nofollow&#8221; onclick=&#8221;javascript:pageTracker._trackPageview(&#8216;/outgoing/article_exit_link&#8217;);&#8221; href=&#8221;http://www.taxmann.net/STOnlineWeb/NewHomePage/Home.aspx?pId=160&#8243;&gt;Service tax&lt;/a&gt; from September 10, 2004 under section 65(12)(a)(ix) of the Finance Act, 1994 which covers ECBs. </p>
<p>&#13;</p>
<p>According to the borrower, the responsibility of paying service tax is of the service provider which is the foreign branch of the Indian bank and, hence, the Indian bank having a permanent establishment in India, is supposed to pay and not the borrower. </p>
<p>&#13;</p>
<p>The contention of the service tax authorities is partially correct after coming into effect of section 66A of the Finance Act, 1994 from April 18, 2006.</p>
<p>&#13;</p>
<p>Until the coming into effect of section 66A, the liability and obligation to pay service tax was that of Indian bank and not that of the borrower. Contrary to the contention of the service tax authorities, even under rule 2(1)(d)(iv) of the said Rules, effective from August 16, 2002 and June 16, 2005 respectively, the borrower cannot be made liable for the payment of service tax.</p>
<p>&#13;</p>
<p><strong>2.</strong> Rule 2(1)(d)(iv) reads as follows :—</p>
<p>&#13;</p>
<p>‘Person liable for paying the service tax’ means,—</p>
<p>&#13;</p>
<p>(iv) in relation to any taxable service provided or to be provided by a person, who has established a business or has a fixed establishment from which the service is provided or to be provided, or has his permanent address or usual place of residence, in a country other than India, and such service provider does not have any office in India, the person who receives such service and has his place of business, fixed establishment, permanent address or, as the case may be, usual place of residence, in India.” </p>
<p>&#13;</p>
<p>From the aforesaid provisions, it would be clear that until April 18, 2006, the requirement under rule 2(1)(d)(iv) was that only in case where the service provider did not have any office in India, the person receiving taxable service was liable for paying service tax involved. In the cited case, the Indian Bank having its registered and head office in India, and a branch in a foreign country cannot be said to be a service provider who did not have an office in India.</p>
<p>&#13;</p>
<p>After coming into effect of section 66A, rule 2(1)(d)(iv), substituted with effect from April 18, 2006 by the Service Tax (Second Amendment) Rules, 2006, reads as follows :—</p>
<p>&#13;</p>
<p>“‘Person liable for paying the service tax’ means -</p>
<p>&#13;</p>
<p>(iv) in relation to any taxable service provided or to be provided by any person from a country other than India and received by any person in India under section 66A of the Act, the recipient of such service;” </p>
<p>&#13;</p>
<p>As such, until April 17, 2006, the borrower was not a ‘person liable for paying service tax’ within the meaning of the Act and the said Rules, including rule 2(1)(d)(iv) thereof.</p>
<p>&#13;</p>
<p>It is relevant to note herein that the phrase ‘does not have any office in India’, in rule 2(1)(d)(iv), stands omitted from the substituted rule. As such, with effect from April 18, 2006, in any case where the taxable service is provided or is to be provided by either a person who has established a business in a country other than India or has a fixed establishment from which the service is provided or is to be provided in a country other than India or has his permanent place or usual place of residence in a country other than India, the service recipient in India would be treated as if it has itself provided the service in India and, accordingly, it would be liable to pay the service tax and comply with all procedural and other requirements as specified in the Act and the said Rules. The respective clauses in section 66A (1) (a) are disjunctive and, hence, once any of the three alternatives contained therein are satisfied, the service recipient becomes liable to pay service tax on the taxable service involved. </p>
<p>&#13;</p>
<p>Applying the aforesaid provision, since the service is being provided by foreign branch of an Indian Bank, the condition precedent laid down in section 66A(1)(a) is satisfied and, in the absence of the phrase ‘does not have any office in India’ in rule 2(1)(d)(iv), as recipient of the services, the borrowers would be liable to make payment of the service tax payable on the ‘Banking and Other Financial Services’.</p>
<p>&#13;</p>
<p><strong>3.</strong> The fees paid or to be paid are liable to service tax under ‘Banking and Other Financial Services’ under the Act with effect from September 10, 2004. The liability to pay service tax for the period prior to April 18, 2006 would be that of Indian Bank and on and from April 18, 2006, would be that of the borrowers.</p>
